Our road transport legal services includes advice on carriage of goods, liens, contractual issues, purchase/sale of businesses and property, employment law including TUPE, commercial disputes and also road transport regulatory work encompassing operator licensing and enforcement issues such as tachograph/drivers hours rules, maintenance, overloading, construction and use offences in the criminal courts and at public inquiries. Dermott Thomas is a Partner in the firm, having joined the practice as an experienced commercial advocate in 1993. In his time with the firm he has contributed to the firm’s acknowledged specialisms in the road transport and agricultural sectors both as an advocate and commercial solicitor.

As an advocate Dermott is experienced in conducting Employment Tribunal cases, Magistrate and County Court cases and also has experience of presenting cases before the Traffic Commissioner for Public Inquiries or driver conduct enquiries. On the road transport side he has been involved in a number of cases for our haulier clients in connection with interpretation of standard carriers terms on goods in transit, including the CMR both in the higher courts in this country and in other European jurisdictions. Other recent cases have involved bailment, liens, questions of insurance cover and sub-contracting logistics arrangements. He also has considerable experience in Health & Safety-related work.

On the agricultural side he has been involved in the firm’s higher profile cases in the EJC as well as more routine cases over crop failure, defective chemicals, livestock illnesses, partnership disputes and professional negligence. In addition to the above, Dermott has been involved in a wide range of other commercial and multi-million pound trust disputes.
